What is Contractors Pollution Liability?

Contractor’s pollution liability coverage for a wide range of classes. Current general liability policies rarely include pollution liability. Now more than ever, contractors need to make sure they are properly covered in the event of a loss. Coverage options include bodily injury, property damage and clean-up costs caused by pollution conditions resulting from covered contracting operations. Mold coverage is also available. The Contractors Pollution Liability/Professional Policy is a combined Pollution and Professional coverage form. It provides coverage to general contractors, construction managers, and various trade contractors who could potentially have both pollution and professional claims; CPL/Professional provides coverage for E&O exposures for contractors.

Minimum premium can vary due to several factors and range from $2,500 without mold, $5,000 with mold and $10,000 for general contractors and home builders seeking mold coverage.

Why is CPL / Professional coverage important?

  1. Because contractors face professional liability issues from construction management services, job site modifications, and other daily activities.
  2. Because E&O exposures for contractors are generally excluded from General Liability and monoline Contractors Pollution Liability policies.

Optional coverage enhancements:

  • Occurrence CPL coverage
  • Natural Resources Damage
  • Coverage for work performed by subcontractors
  • Mold coverage
  • Blanket Additional Insured
  • Waiver of Subrogation
  • Transportation Pollution Liability

Trends in the Marketplace for Contractors Pollution Liability

Since the 1980s, commercial liability policies written for contractors have either excluded or have provided very limited coverage for pollution exposures. Many contractors are required to carry pollution insurance by contract, while other prudent contractors have chosen to protect their bottom line by purchasing blanket environmental insurance coverage. Relying on general liability coverage extensions or ignoring environmental exposure altogether can ultimately lead to paying for costly environmental claims with company profits or worse, by liquidating company assets. Contractors face environmental risk on a daily basis from both foreseen and unforeseen exposures:

  • Fuel spills for equipment stored on jobsites
  • Exasperation of unknown existing environmental conditions at a jobsite
  • Equipment exhaust causes indoor air quality issues
  • Construction material off-gassing causes sick building syndrome
  • Completed operations exposure from mold and bacteria growth
  • Subcontractors cause pollution incident

Environmental claims are derived from all aspects of the contracting industry. General contractors, mechanical contractors, street and road contractors, utility contractors, even landscaping contractors have seen their share of environmental claims activity. Environmental claims are often very expensive to settle and even more costly to defend. Third party bodily injury, property damage, and cleanup costs typically run into the hundreds of thousands of dollars and beyond. Our carriers provide a menu of CPL insurance programs that takes and provides effective, dedicated environmental insurance coverage to your contractors with the following features:

  • Occurrence or Claims-Made coverage
  • Coverage for third party bodily injury, property damage, and cleanup costs
  • Legal defense expenses
  • Coverage for subcontractors exposure
  • Mold coverage available
  • Low deductible and minimum policy limits of $1,000,000
